Nullification

A summons to nullify a patent may be issued in order to have a granted patent partially or completely revoked in a procedure. A number of requirements apply to registering the revocation of a patent in the Netherlands Patent Register.

  • You must submit original documents or the copy must be compared by the bailiff with another copy upon submission.
  • The patent right number must be clearly stated.

Fees
Registration of a summons to revoke a patent costs 27 euro per patent number. You can transfer this sum to the bank account of NL Patent Office.

Withdrawal of a summons to nullify a patent
In the procedure to nullify a patent, the requesting party can withdraw the demand for nullification.

  • The patent right number must be clearly stated.
  • The letter must be signed by the requesting party or by his/her attorney.

Fees
There is no charge for registration.

Registering the final decision of nullification
The court ultimately issues a ruling in the procedure of nullifying a patent. This final decision is entered in the patent register once it is received.

  • The relevant patent right number must be clearly stated.

There is no charge for registration.

Any amendment that is registered by means of a deed is entered in the patent register with retroactive effect.
