These fees are compliant with Dutch Patent Law. All amounts are calculated in euro.

Annual fees as of 5 June 2008

In order to maintain a patent in the Netherlands, an annual fee must be paid to NL Patent Office. The first payment is due at the start of the fourth year after the application has been filed. There is a fixed annual fee per year, depending upon the year after the application was filed. The last day upon which the annual fee (without increase) can be paid is the last day of the month in which the patent application has been filed.

Paying on and after the expiry date

In order to maintain a patent in the Netherlands, an annual fee must be paid to NL Patent Office. The first payment is due at the start of the fourth year after the application has been filed. There is a fixed maintenance fee per year, depending upon the year after the application was filed. The last day upon which the annual fee (without increase) can be paid is the last day of the month in which the patent application that resulted in the patent has been filed. However:

  • If the patent has been granted to a divisional patent application, the month of filing of the original patent application shall be the determining factor.
  • If the patent is granted in or after the fourth year, the initial payment shall be due immediately if the day/month upon which the patent has been granted is the same as or falls before the day/month upon which the application has been submitted.
If you wish to pay the annual fee for a patent that has not yet been granted, NL Patent Office would prefer you to state the day upon which the patent shall be granted. Late payment is permitted up to six months after the day upon which the payment is due. If that is the case, an increase of 50 percent of the annual fee applicable at that time shall be due. There is however an exception: If the first annual fee has to be paid within a period of two months after the day upon which the patent has been granted, the amount can still be paid on the last day of the month in which this period ends without being subject to an increase. If an annual fee with a penalty is not paid within six months after the date upon which the patent expires, the patent shall expire irrevocably.

Please note

  • It is the responsibility of the patent holder to pay the annual fee on time.
  • NL Patent Office does not sent any invoices for annual fees, deeds, requests etc.
  • As a government agency NL Patent Office is not subject to VAT, therefore no VAT will be calculated on annual fees, deeds, requests etc.
